AiCallAgents provides AI-powered voice agent services designed to handle inbound and outbound business calls. Our Service includes automated call answering, lead qualification, appointment scheduling, and CRM integration. The specific features available to you depend on your subscription plan.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to pay all applicable fees as described on our pricing page. Subscriptions automatically renew unless cancelled before the renewal date. Setup fees are non-refundable. Monthly subscription fees may be refunded on a pro-rata basis if you cancel within the first 14 days of your billing cycle.

• Setup fees are due upon account activation
• Monthly fees are billed at the start of each billing cycle
• Minute packages are consumed based on actual usage

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. Prohibited activities include but are not limited to:

• Using the Service for illegal telemarketing or spam calls
• Violating any applicable telecommunications regulations
• Attempting to gain unauthorized access to our systems
• Interfering with other users' access to the Service
• Using the Service to harass, threaten, or defraud others
• Misrepresenting the AI agent as a human when legally required to disclose

6. Intellectual Property

The Service and its original content, features, and functionality are owned by AiCallAgents and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you provide to the Service, but grant us a license to use that data to provide and improve the Service.

7. Call Recording and Data

Calls handled by AI agents may be recorded for quality assurance and training purposes. You are responsible for ensuring compliance with all applicable call recording laws in your jurisdiction, including obtaining any required consent from callers. We provide tools to help you comply with these requirements, but ultimate responsibility rests with you.

8. Service Availability

We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of scheduled maintenance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, AiCallAgents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AiCallAgents and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
